Terms of Service

These Terms of Service ("Terms") govern your access to and use of XactIQ, a software-as-a-service platform operated by McEntire Construction & Consulting LLC ("we," "us," or "our"). By creating an account or using XactIQ, you agree to these Terms. If you do not agree, do not use the service.

1. Use of the Service

XactIQ is a CRM and AI-powered supplement analysis tool designed for roofing and restoration contractors. You may use it only for lawful business purposes and in accordance with these Terms.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring any data you upload or input is accurate and lawfully obtained
  • Compliance with all applicable laws when submitting insurance supplements

2. Subscription and Billing

XactIQ is offered on a subscription basis. Fees are billed in advance on a monthly or annual basis depending on your chosen plan. All fees are non-refundable except as required by law or as expressly stated in a separate written agreement.

We reserve the right to modify pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

3. AI-Generated Content Disclaimer

XactIQ uses artificial intelligence to analyze insurance estimates, suggest supplement items, and apply building code requirements. AI output is provided for informational purposes only and does not constitute legal, financial, or professional advice.

You are solely responsible for reviewing all AI-generated supplement items, verifying their accuracy, and determining their appropriateness for submission to any insurance carrier. We make no warranties regarding the accuracy, completeness, or fitness of AI-generated content for any particular purpose.

4. Data and Privacy

Your use of XactIQ is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the service, you consent to the collection and use of your data as described in the Privacy Policy.

You retain ownership of all client data, documents, and records you upload to XactIQ. You grant us a limited license to store and process that data solely to provide the service to you.

5. Acceptable Use

You agree not to:

  • Submit fraudulent, inflated, or knowingly inaccurate insurance supplements
  • Use XactIQ to facilitate insurance fraud or bad faith claims practices
  • Reverse engineer, decompile, or attempt to extract source code from the service
  • Resell or sublicense access to the service without prior written consent
  • Use automated tools to scrape or bulk-download data from the service

6. Intellectual Property

XactIQ and its underlying technology, including but not limited to the Xactimate pricing database integrations, AI models, and code requirements engine, are the property of McEntire Construction & Consulting LLC and its licensors. Nothing in these Terms transfers any intellectual property rights to you.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MCENTIRE CONSTRUCTION & CONSULTING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

8. Termination

You may cancel your subscription at any time through the billing portal. We may suspend or terminate your account for violation of these Terms, non-payment, or for any other reason with reasonable notice.

Upon termination, you may export your data within 30 days. After that period, we may delete your data from our systems.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
